A legal disclaimer

PCP-Health, PLLC, is  committed to protecting the privacy of your protected health information (PHI). As a covered healthcare provider under the Health Insurance Portability and Accountability Act (HIPAA), we follow federal privacy standards to safeguard your individually identifiable health information.

 

This includes information about your medical history, symptoms, test results, and payment details. We also comply with Florida laws that provide greater protections where applicable, such as restrictions on offshore storage of health records and mandatory reporting for public health purposes.

 

Your PHI We may use and disclose your PHI for treatment, payment, and healthcare operations (TPO) without your authorization:

Treatment: Sharing with other providers (e.g., specialists) to coordinate care.

Billing insurers like Medicare or submitting claims.

Operations: Quality improvement, compliance reviews, or training.

Other permitted disclosures without authorization include:

Public health reporting (e.g., communicable diseases to Florida Department of Health).

neglect reports (e.g., to DCF for child or vulnerable adult cases).

Law enforcement (e.g., gunshot wounds or evidence of crime).

Business associates (e.g., EMR vendors like Headway or Practice Better) undersigned agreements.

non-TPO uses (e.g., marketing, research), we obtain your written authorization. You may revoke authorizations in writing, except to the extent we have already acted.

Rights Regarding Your PHI

Access: Request copies of your records (fees may apply; response within 30 days).

Amend: Request corrections if inaccurate (we may deny but explain why).

 

Accounting: Get a list of disclosures (last 6 years, excluding TPO).

 Request limits on uses/disclosures (not always required).

Communications: Request alternative delivery methods (e.g., private email).

Notification: We notify you if unsecured PHI is breached.

Duties We maintain physical, technical, and administrative safeguards for PHI.

 

We train staff on privacy policies and sanction violations.

Our practices may change; updates will be posted in the office and on our website (e.g., pcp-health.com).

Complaints: Contact our Privacy Officer if you believe your privacy rights were violated (no retaliation).

 

File with HHS Office for Civil Rights (1-800-368-1019 or ocrportal.hhs.gov).
